We take user privacy seriously and make reasonable efforts to protect it. We have created this Privacy Policy (hereafter “Policy”) to share with you our information collection and use practices. AS MORE CLEARLY DEFINED HEREIN, WE WILL NEVER KNOWINGLY SELL OR ASSIGN YOUR PERSONAL INFORMATION WITHOUT YOUR KNOWLEDGE AND/OR APPROVAL.
This Policy will inform you about how we handle your personal data when you visit our website (regardless of where you visit it from), tell you about your privacy rights, and explain how the law protects you.

1.1 This Policy aims to give you information on how the Company collects and processes your personal data through your use of our website, including any data you may provide through our website when you sign up for our newsletter, purchase a product or take part in a competition.

1.4 If proof comes to the Company's attention that an individual user is under 18 and accessing our website and/or products without the consent, approval, or authorisation of their parents or legal guardian, the Company will immediately terminate such user’s account.

2. Policy Changes
2.1 This Policy became effective on 01/06/2024.
2.2 We reserve the right to modify this Privacy Policy at any time, so please review it frequently. We will post a copy of the updated Policy on our website before any change becomes effective, and we urge you to check this Policy frequently to determine whether any changes have been made. If we make any material changes, we will notify you of such changes by email in advance. Your continued use of our website, including your registering or placing an order on our website, following any changes to the Policy (which you will be notified of as described above) signifies your acceptance of those changes.
2.3 It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.
3. Data Collection
3.1 Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).
When you visit, register or order products via our website, you may be asked to provide certain personal data.
3.2 The different kinds of personal data that you may be asked to provide, which we have grouped together, including the following:
3.2.1 Identity Data: Includes first name, maiden name, last name, username or similar identifier, password, order number, marital status, title, date of birth and gender.

3.2.3 Financial Data: Includes financial and payment data (held in encrypted/tokenised format only, as the full data is held by our third-party payment providers).
3.2.4 Transaction Data: Includes details about payments to and from you and other details of products you have purchased from us.
3.2.5 Profile Data: This includes your username and password, date of birth, age, location, purchases or orders made by you, interests, preferences, feedback, and survey responses.
3.2.6 Marketing and Communications Data: This includes your preferences in receiving marketing from us and our third parties and your communication preferences.
3.3 We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.
3.4 We also collect, use and share Aggregated Data, such as statistical or demographic data, for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this Policy.
3.5 Where we need to collect personal data by law or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, we may not be able to provide the products that you have ordered from us). In this case, we may have to cancel an order for a product that you have made with us (and our standard cancellation terms will apply), but we will notify you if this is the case at the time.

5. Direct Marketing/ Communication Preferences
5.1 We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. 5.3 We would also like to contact you by post to let you know of our new collections and any offers we may be running. This will usually be in the form of our latest brochure. If you're an existing Elysium Beauty customer, we will send you our brochure (unless they have ‘opted out’ of receiving such communications) as we believe it is in your legitimate interest to receive these.
5.4 We may share your personal data with carefully selected retail companies and charities who we feel may be of interest to you so that they can send you a copy of their brochure or other marketing by post. 5.5 If you unsubscribe or opt out of communications from us, we are not responsible for removing personal data from the lists of any third-party partner or advertiser who has previously been provided with your information in accordance with this Policy and with your consent.
5.6 Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a product purchase, warranty registration, product/service experience or other transactions.
6. Personal Data Disclosure
6.1 The personal data you provide to us may be accessed by or given to third parties who act for us for the purposes set out in this Policy or for other purposes approved by you. Those parties process information, fulfil and deliver orders, process credit card payments and provide support services on our behalf.

6.3 In addition to the above, we may also share your personal data with the following third parties in the following circumstances:

7. International Data Use
7.1 Many of our external third parties are based outside the European Economic Area (“EEA”), so their processing of your personal data will involve a transfer of data outside the EEA. 9. Third-Party Websites
9.1 Our website may contain links to various third-party websites, plug-ins and applications and the external websites of our advertisers and/or third-party partners. Each of these websites may have a privacy policy that differs from that of the Company. This Policy does not cover the privacy policies of other websites, nor do we control these third-party websites, and are not responsible for their privacy policies. We urge you to check the privacy policies of each website that you may visit or interact with.
9.2 The Company provides banners and other advertising on its website from Google and other third parties that may place and read cookies on your browser or use web beacons to collect information in the course of advertisements being served. If you are concerned about your privacy regarding these advertisements, please refer to Google’s (or other third-party) privacy policies.
10. Data Security
10.1 We employ security measures to protect, so far as reasonably possible, your personal data from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage. We will retain your information for a reasonable period or as long as the law requires or permits.
10.2 Unfortunately, information transmission via the Internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our website; any transmission is at your own risk.
10.3 We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
10.4 The Company never uses or installs spyware on user computers, and we do not use spyware to retrieve information from user computers.
11. Legal Rights

11.1.5 Request restriction of processing of your personal data. 11.3 You will not have to pay a fee to access your personal data (or to exercise any of the other rights set out above). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.
11.4 We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
11.5 We will try to respond to all legitimate requests within one month. Occasionally, it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
12. Personal Data Storage
12.1 We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
12.2 To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.
12.3 By law, we must keep basic information about our customers (including Contact, Identity, Financial, and Transaction Data) for 6 years after they cease to be customers for tax purposes.
